International child abduction — the Hague Convention route to return

REVIEWED BY: Sean McNamara on 2026-08-31

What the 1980 Hague Convention is

The 1980 Hague Convention on the Civil Aspects of International Child Abduction is an international treaty. If a child is wrongfully removed from their country of habitual residence to another Hague country, the Convention provides a route to have the child returned. The UK is a member (via the International Child Abduction and Contact Unit, ICACU).

When it applies

  • The child is under 16 and was habitually resident in a Hague member country
  • The child was wrongfully removed (taken without the consent of the holder of custody rights) or not returned (retained abroad after agreed contact)
  • The destination country is also a Hague member

The right of return

If those elements are met, the return is the default unless a limited defence applies:

  • The removal is over a year old and the child is now settled in the new country (with consent issues)
  • Grave risk that return would expose the child to physical or psychological harm
  • The child objects and is old/mature enough for that to matter
  • Consent or subsequent acquiescence by the left-behind parent

How to apply through ICACU

1. Act fast — delay harms your position 2. Contact ICACU (the Office of the Official Solicitor): https://www.gov.uk/government/publications/international-child-abduction-and-contact-unit 3. ICACU prepares and transmits the application to the foreign Central Authority free of charge 4. The foreign authority/court orders the child's return or considering the defences

Non-Hague countries

If the child is in a non-Hague country, the Convention doesn't apply. Options are far harder:

  • A wardship / Tipstaff order in the High Court
  • Proceedings in the foreign country's courts (via local lawyers)
  • Diplomatic assistance via the FCDO / British embassy
  • See our Tipstaff and international guides

Urgent steps if taking next steps

  • 999 if the child is being removed right now
  • Prohibited Steps Order urgently from the family court
  • Passport flag — tell the Passport Office the child should not get travel documents
  • Port alert via the police
